Law in Malaysia

Law is a system of rules and guidelines, usually enforced through a set of institutions. It shapes politics, economics and society in numerous ways and serves as a social mediator of relations between people. For example, Contract law regulates everything from buying a bus ticket to trading on derivatives markets and Property law defines rights and obligations related to the transfer and title of personal and real property and so on. Then, Natural law or the law of nature (Latin: lex naturalis) has been described as a law whose content is set by nature and is thus universal. As classically used, natural law refers to the use of reason to analyze human nature and deduce binding rules of moral behavior While Rule of Law is the absolute supremacy of the law over everybody, both the rulers and the ruled. The rule of law is a legal maxim that provides that no person is above the law, that no one can be punished by the state except for a breach of the law, and that no one can be convicted of breaching the law except in the manner set forth by the law itself. NATURAL LAW The unwritten body of universal moral principles that underlie the ethical and legal norms by which human conduct is sometimes evaluated and governed. Natural law is often contrasted with positive law, which consists of the written rules and regulations enacted by government. The term natural law is derived from the Roman term jus naturale. Adherents to natural law philosophy are known as naturalists. Naturalists believe that natural law principles are an inherent part of nature and exist regardless of whether government recognizes or enforces them. Naturalists further believe that governments must incorporate natural law principles into their legal systems before justice can be achieved. There are three schools of natural law theory: divine natural law, secular natural law, and historical natural law. Common law in Malaysia takes the form of Natural law RULE OF LAW: The Rule of Law, in its most basic form, is the principle that no one is above the law. The rule follows logically from the idea that truth, and therefore law, is based upon fundamental principles which can be discovered, but which cannot be created through an act of will. The most important application of the rule of law is the principle that governmental authority is legitimately exercised only in accordance with written, publicly disclosed laws adopted and enforced in accordance with established procedural steps that are referred to as due process. The principle is intended to be a safeguard against arbitrary governance, whether by a totalitarian leader or by mob rule. Thus, the rule of law is hostile both to dictatorship and to anarchy. The rule of law in its modern sense owes a great deal to the late Professor AV Dicey. Professor Dicey's writings about the rule of law are of enduring significance. The essential characteristic of the rule of law are: i. The supremacy of law, which means that all persons (individuals and government) are subject to law. ii. A concept of justice which emphasises interpersonal adjudication, law based on standards and the importance of procedures. iii. Restrictions on the exercise of discretionary power. iv. The doctrine of judicial precedent. v. The common law methodology. vi. Legislation should be prospective and not retrospective. vii. An independent judiciary. viii. The exercise by Parliament of the legislative power and restrictions on exercise of legislative power by the executive. ix. An underlying moral basis for all law. Legislative Authority – Source of Primary Legislation- Malaysia Legislative authority is the power to enact laws applicable to the Federation as a whole under Article 66(1) of Federal Constitution. At Federal level, the legislative power is vested in a bicameral Parliament headed by the  Yang di-Pertuan Agong  and comprises the  Dewan Negara  (House of Senate) and  Dewan Rakyat  (House of Representatives). The  Dewan Negara  has 70 members, of whom 44 are nominated by the  Yang di-Pertuan Agong, and 26 elected by the State Legislative Assemblies. The  Dewan Rakyat  is fully elected and has 219 members. The duration of the life of each Parliament and State Legislatures is about five years and is split into one-year sessions, after which the session is terminated or prorogued usually in September. The distribution of law-making authority between the Federal and State Governments is enumerated in the Ninth Schedule of the Federal Constitution; and is set out in a Federal List, State List and a Concurrent List. The main subject areas of the Federal List are external affairs, defence, internal security, civil and criminal law, citizenship, finance, commerce and shipping industry, communications, health and labour. EXECUTIVE AUTHORITY – Source of Subsidiary Legislation Malaysia The Executive is vested with the authority to govern and administer the laws by way of delegated and drafts Bills as provided under Article 39 of the Federal Constitution. The power to govern that is vested in the  Yang di-Pertuan Agong  is however exercisable by a Cabinet of Ministers headed by the Prime Minister. The Cabinet is answerable to the  Yang di-Pertuan Agong  as the head of Executive Authority in the country. Each executive act of the Federal Government flows from his Royal authority, whether directly or indirectly. However, in accordance with the principle of a democratic ruling system, the Chief Executive is the Prime Minister. The  Yang di-Pertuan Agong  appoints a Cabinet – a council of Ministers – to advise him in the exercise of his functions. It consists of the Prime Minister and an unspecified number of Ministers who must all be members of Parliament either the  Dewan Rakyat  (House of Representatives) or  Dewan Negara  (House of Senate). The Ministers hold different portfolios and are collectively responsible for all decisions made by the Cabinet, which is the highest policy-making body in the country. Judicial Authority – Source of Case Law The Judiciary is empowered to hear and determine civil and criminal matters, and to decide on the legality of any legislative or executive acts as provided under Article 125A of the Federal Constitution. It is also conferred authority by law to interpret the Federal and State Constitutions. The courts can pronounce o n the validity or otherwise of any law passed by parliament and they can pronounce on the meaning of any provision of the constitution. The jurisdiction of the Malaysian courts is determined by the Courts of Judicature Act 1964 for Superior Courts and the Subordinate Courts Act 1948 for Subordinate Courts The Malaysian Courts of Justice are made up of the Superior Courts and the Subordinate Courts. The Superior Courts comprise of the Federal Court (the highest court), the Court of Appeal and the two High Courts. By virtue of Act 121(1) of the Federal Constitution judicial power in the Federation is vested on two High Courts of Coordinate jurisdiction and status namely the High Court of Malaya for Peninsular Malaysia and the High Court of Borneo for Sabah and Sarawak. ———————————————— In conflict with natural law Upholding the rule of law can sometimes require the punishment of those who commit offenses that are  justifiable  under  natural law  but not statutory law. Laurie’s lies In the story â€Å"Charles† , Shirley Jackson vividly creates an entertaining main character, Laurie, through a description of his own looks, clothing, his own words, and actions. Shirley Jackson shows Laurie as having three main personality traits. Laurie can be best described as rude, impish, and disruptive. Early on in this story Laurie shows us his rude behavior when he starts kindergarten. Laurie is rude to everyone. He is rude to his teacher, his dad, and his mom.He says to his dad â€Å"hey pop you old dust mop†. That’s rude most dads would have slapped him. Laurie shows another trait later on in the story â€Å"impish†. He got in trouble and the whole class stayed to watch what would happen. He also makes up this character Charles he tells his mom that â€Å"Charles does whatever he really does at school. † That is just some really impish attitude. Laurie also has a third trait disruptive. Laurie disrupts the whole class a lot in this story. He tells a little girl in his class to say a bad word. † The little girl did and got in trouble. Then Laurie goes ahead and says the word himself and gets in trouble. That shows disruptive behavior. In our world today kids are the same. They all do stuff to get attention. This story will bring to parents attention how their kids act when they are not around. All kids today can have the same characteristics as Laurie does rude, impish, and disruptive.

African American Literatury Essay African-American literature can be defined as writings by people of African descent living in the United States of America. The African-American literary tradition began with the oral culture long before any of the materials in it were written on. Throughout their American history, African-Americans have used the oral culture as a natural part of black expressive culture. They are very powerful voices that give fuller meanings to words on a page. The America South is an important landscape in African-American literature. The South was a primary port of entry for slaving vessels. Most black slaves remained in the Southern states. The South was an important place for the African-American literature because the South was served as the site of hope and change for the black slaves but there were also horrors. The majority of African captives entered the New World from the Southern ports and remained in the Southern states. They relied heavily on the African cultural heritage and belief systems familiar to them. During their 300 years of slavery and servitude, black slaves and their descendants developed a complex relationship with the South. Amiri Baraka concluded that the South is a part of the scene of the crime, a land that is about the site of hope and the scene of the crime. For many African Americans, the South serves as the site of hope and change. The South has given birth to many African-American cultural practices, such as literature. This is the spiritual and ancestral home for African Americans and plays a dominant role in African-American literature. Before the American Civil War, African-American literature primarily focused on the issue of slavery, as indicated by the subgenre of slave narratives The most noted authors were all incited and inspired by the goings on in the south. Frederick Douglass was one of the most important African-American authors from the literary landscape in the South. He chronicled his life from bondage to freedom in his Narrative of the Life of Frederick Douglass, an American Slave, Written by Himself (1845), which helped the American public to know the truth about the institution of slavery and dismiss the myth that slaves were happy and treated well. He said, the South was not only a notorious site of slavery, it was also a landscape of racial terror and widespread violence. The biggest crime the South ever committed is the institution and perpetuation of slavery. But the Southern landscape is more than just the â€Å"scene of the crime† in African-American literature. It has multiple personalities that demand multiple treatments. Many 20th-century African-American writers, whether born and raised in the South or not, have used the southern landscape in their works to explore the complex relationships African-American communities have with the South. In her poem â€Å"Southern Song,† Margaret Walker (1915 – 1998) sings a praise song to the southern suns and southern land despite the â€Å"mobs† and â€Å"a nightmare full of oil and flame. Southern Song I want my body bathed again by southern suns, my soul reclaimed again from southern land. I want to rest again in southern fields, in grass and hay and clover bloom; to lay my hand again upon the clay baked by a southern sun, to touch the rain-soaked earth and smell the smell of soil. I want my rest unbroken in the fields of southern earth; freedom to watch the corn wave silver in the sun and mark the splashing of a brook, a pond with ducks and frogs and count the clouds. Geriatric Health Conditions: Types, Causes and Support Name: Clare Josephine Montuya Student No: 12001442 Introduction Generally, as we are living in the area of progression, we forget to look back into the ones, who in their prime, have done their best to establish the growing community that we are today. We tend to forget that we age along just like them. From this sentiment alone, we should be able to return the favour by means of answering their needs in a holistic manner and at the same time educating future generations about any problems that may arise from present-day health care so they would innovate means to address them in the near future. Time after time, problems tend to arise not from the premise that people have pre-existing health-related problems but from needs that have been overlooked or unaddressed. This report aims to discuss existing knowledge on common geriatric conditions, support organizations as well as services provided to the present day geriatric population so that rest homes, particularly Kindly Residential Care Rest Home, would be able to meet or exceed the expectations of clients or residents. Task 1 Dementia Dementia is a progressive-degenerative disorder that widely affects the general geriatric populace. It is progressive in a sense that those affected by it tend to develop severe symptoms as they age and degenerative by nature because of degeneration of certain and/or parts of the brain, resulting into changes in cognition, emotion, behaviour and personality. Although this may be prevalent among the elderly, this does not mean that the young adult populace is exempted from such. In present-day society, young adults tend to develop symptoms sooner than they think and tend to disregard the possibility of developing dementia in the long run. A hallmark sign of dementia is forgetfulness or short term memory loss. People as early as in their twenties tend to forget the keys to their room, their mobile phones, their assignments, and all other day to day activities no matter how simple these tasks may seem. But memory loss alone is not enough to diagnose dementia. A person should be able to have memory loss accompanied by four or more of the following criteria: language disturbance, trouble carrying out motor activities, failure to recognize or identify objects and trouble with planning, organising things and making judgments (Perkins, 2013). The severity of dementia can be categorized into mild, moderate and severe. In mild dementia, one can still be independent in carrying out certain tasks though they may tend to have one or two symptoms of it. This is most prevalent in the young to middle adult stage. In moderate dementia, supervision may be required to be able to execute important tasks and most likely some of a few activities of daily living. In severe cases, full and extensive assistance and supervision is needed to carry out activities of daily living. Early Stages of Dementia Early symptoms of dementia may vary in progression depending on the type of dementia presented. Dementia may be categorized into the following: Alzheimer’s disease Short term memory loss is the most profound symptom of the disease. A good example of such would be losing or misplacing things, inability to concentrate or focus, inability to follow conversations, have trouble using the telephone since he or she would tend to forget phone numbers, inability to keep track of recent events at certain times and constantly ask questions for a time because he or she forgot the answer. Another symptom would be having trouble to plan, organize or carry out decisions. One could forget to pay the bills on time or even keep track of certain events in the office and the like. Poor sense of direction is another where one lost his or her way in a mall he or she has visited more than twice in a week. Emotional changes may happen as well, such as increased anxiety, embarrassment in social situations, anger or frustration, powerlessness, suspiciousness, boredom or worse depression. Vascular Dementia Due to any damage or obstruction in the blood vessels in the brain, certain parts of the brain are deprived of oxygen from insufficient blood supply, hence causing damage to certain lobes of the brain responsible for cognition and emotion. Although short-term memory loss is a common denominator for all types of dementia, another significance of this type is the earlier onset of the loss of executive skills. Considered to be an after effect of multiple stroke attacks, it causes a lot of frustration, most particularly the emotional aspect of a person’s well-being. They become overly emotional at most times. In the medical world, a person becomes labile. A person may tend to be furious over a small issue or even cry at something funny. Lewy body dementia Persons suffering from this type of dementia would usually display loss of concentration and impaired judgement. Short-term memory loss is usually present but at its earliest stages, it is way better compared to Alzheimer’s disease. Another unique symptom would be able to have visual hallucinations, which would eventually lead to fear and depression. Frontal lobe dementia The front lobe of the brain is mainly affected in this particular type of dementia due to insufficient blood supply. They may have some similarities with vascular dementia but in its earlier stages, people suffering from such type would initially experience personality changes such as being tactless or breach rules of social etiquette. They tend to have difficulty expressing their feelings and have a problem reciprocating the appropriate response or emotion. Worst case scenario, they express no concern for their surrounding environment. They tend to feel that they are purposeless, so they tend to slack off or feel powerless to do anything. As a result, hygiene would be a concern for them and would require assistance and supervision in carrying out certain tasks of daily living. Interventions Regardless of what type of dementia the person has, dementia in its early stages is not to be taken lightly. Awareness is the key so information on dementia should be disseminated especially to clients and their families who are directly affected by it. This also does not limit to direct family members of the client but also to other health care professionals involved in his or her care. Taking care of the financial and legal aspect in the earlier stages of dementia is one of the many important things to prepare before the client. Security of assets such as having joint accounts, or preparing last will and testament and making advance directives before the client reaches a severe stage of dementia. Another would be to develop a routine for them to do and make these tasks simpler than they used to be. In any case there is a certain routine that they stick to, never break their routine. Providing them references to different support groups and providing access to their services is the best intervention so they could achieve the quality of life they desired. Support Organizations Access to these support groups would be essential to the geriatric populace. Alzheimer’s New Zealand This organization aims to disseminate information and promote high standards of education for people with dementia, their caregivers, families and health professionals. The regional member organisations may offer all or some of the following services: Support through group â€Å"get-togethers† for the person diagnosed with dementia Support group meetings for carers and family members Home visits by member organisation staff or field workers Carer education programmes Volunteer services Day-care programmes Regular newsletters Library – books and audio resources (http://www.alz.org/documents_custom/world_report_2012_final.pdf ) Eldernet This support group provides options to clients as to how and where they want their care delivered. National Dementia Cooperative The said support group has been created to facilitate sharing of information regarding support systems made available and share ideas to achieve the goals of the cooperative. Age concern Age Concern provides free and confidential Elder Abuse and Neglect Prevention Services in many major cities and provincial areas throughout New Zealand. These services employ professional staff to work with older people and their carers, providing support and advocacy so that older people can be happy, healthy and safe. The services also raise awareness of elder abuse by providing education for aged care workers, community groups, families and anyone with an interest in the wellbeing of older people. There are also other providers of Elder Abuse and Neglect Prevention Services. People entering into residential care would normally experience separation anxiety and would be difficult for the staff to establish rapport. As much as possible, an initial assessment for the first 48 hours is made and the staff should be able to gather enough information as to the routine care that they will be able to include in their care. After enough background history or information is gathered, a profile is made as basis for the plan of care. The care plan is then discussed with the family and must be reviewed or updated every six months or when significant changes have taken place. Regular meetings with the family are held every now and then to promote collaboration in the care of the patient. Activities cannot be only limited to the confines of the facility but outings are encouraged as well. A walk in the park, spending the afternoon in a familiar coffee shop or any recrea tional activity that keeps them company. But when it comes down to having outpatient visits to the doctor, a family member must accompany them as they know the history of the patient well than any other caregiver. In any case they wish to have services such as a reflex massage on the foot, or a manicure or pedicure, or hairdresser, these services can be brought from the nearest parlour to their very doorstep. But when dementia gets severe enough that the facility can’t handle, these clients will then be endorsed or sent to a higher level of care facility such as the hospital. End of Life Support Palliative care is an essential care pathway when clients reach their terminal stage in life. This not only applies to the physical aspect but also the emotional, cultural and spiritual well-being as well. Advance directives are made in advance while the client’s cognition is still intact and involve the family as well in the decision-making. Heaps of issues tend to arise from this as well, affecting the delivery of care to clients. One would be medical issues, such as addressing clients with terminal stage illnesses like pneumonia, cancer, chronic kidney disease, diabetic ketoacidosis, stroke and more chronic diseases. We should also consider the hydration status and nutrition of each of the clients to ensure that they keep up with their nutritional needs. Another issue to address is euthanasia or â€Å"Death by Dignity†, an ethical issue that is still debatable to this day. According to Perkins, a system called Liverpool Care Pathway was developed to ensure the best p ossible end-of-life care delivered to the individual in the last few days of his or her life (Perkins, 2013). In the care of the terminally ill in the home setting, a private duty nurse can be arranged to assist the family in taking care of the client. Hospices Though this may be similar to end of life support, these facilities specialize in taking care of demented clients with diseases such as cancer or HIV/AIDS. Palliative care is still the main intervention for this facility. Hospitals These facilities offer numerous services open 24/7 to be able to cater to the health needs of patients requiring a higher level of care. In this setting, they require to people to assist in the care of the client. Demented clients who become frail and enter into dementia of a severe kind are most likely to be admitted. Raising awareness of dementia, especially in its early stages, and eradicating any stigmas surrounding it would be able to help the affected individuals gain access into support systems that are readily available to accept them and advocate their rights to proper care and treatment. The Civil War was the bloodiest war to be fought on American soil. Although both sides expected the conflict to be over in a matter of days, it lasted four tumultuous years, from 1861-1865. The war pitted brother against brother, neighbor against neighbor. The period of Reconstruction, the time when our nation attempted to mend its broken relations with the South and rebuild after the destructive war, lasted until 1877. What many people don’t know is that the original intent of the Civil War was to preserve the Union. Many factors went into Lincoln’s decision to also address slavery through this war. For one, the number of men enlisting in the war was dwindling, and it became apparent that black manpower would be absolutely necessary to win the war. Also, the increasingly upset Radical Republicans and abolitionists let their opinions be known and persuaded the citizens of the North that the war could not be won without attacking the issue of slavery. Finally, Lincoln believed that transforming the dispute from a conflict to preserve the Union to a crusade against slavery would dissuade the threatening British and French from supporting the Confederacy. With its new stated purpose, the Civil War would now have huge societal repercussions. The largest and most complex issue of Reconstruction was how to go about admitting the Confederate states back into the Union. President Lincoln’s plans were quite lenient, accepting the seceded states back into the Union even if by vote only a minority of a state’s white males took an oath of loyalty to the United States. However, John Wilkes Booth assassinated him before any of his plans could go into action. His replacement, vice president Andrew Johnson, a democrat, was left in a difficult predicament. Public opinion at the time favored that the South should face some sort of retribution for their past acts, and promise loyalty for the future before they were to be pardoned. At the time, many Northerners were Republicans; Southerners were largely democratic. The biggest supporters of an extreme Reconstruction process were the Radicals. Many of them argued that the confederate states had lost their constitutional identity; however the Republicans would only go so far as to say that by seceding the southerners had forfeited their rights. They were to be kept out of the Union until they had demonstrated a proper spirit of repentance. Radicals convinced enough moderate Republicans of this that Congress passed the Wade-Davis bill, which postponed Reconstruction until a majority of a state’s white males (not just 10%) took an oath of loyalty.

Filled with time flavored symbolism, this carpe diem poem, "To His Coy Mistress" by Andrew Marvell, exemplifies the seize the day theme. The cyclical, life symbolizing river, the water flowing by like time, is the first place Marvell places the characters. And even though they are very far apart, time still flows by for them both. As the water flows, this concept begins to hint at the shortness of time, for them to have sex, the source of new life. He then proceeds to claim that he could love her ten years before the flood, something already ancient, and up to the end of the world, using the juxtapositioning of the two views of time enhance his argument and to convince to accept his offer by telling her of his long-term commitment for her in the short-term. This flood also symbolizes life in the fresh start of the new covenant. Because time keeps going, with or without them, they must be active participants and not just the static spectator. Otherwise, the fate Marvell relates would become their reality....

Tupac Shakur - His Impact on American Culture Tupac Shakur was a very influential person in the 20th century. He was born on June 16, 1971 in Brooklyn New York, and died on September 13, 1996 in Las Vegas Nevada (unknown author, no title, no page, letter code C). But his family moved around a lot while he was a kid (Bastin, J.D.). He eventually ended up in the Bay Area California alone and spent his first two years there homeless (unknown author, no title, n.p., letter code D). He grew up with only his mom and loved her very much. He even wrote a song called Dear Mama to his mom and thanked her for how she tried her best at raising him. His public career started when he joined the seminal Bay Area rap ensemble (u.a., "original area," n.p.). He started as a tour dancer but then started rapping live (u.a., "original area," n.p.). From there he released a couple albums and then was offered to be in some movies. He became friends with a couple of popular rap artists like Snoop Doggy Dogg and Dr. Dre (Placid n.p.). He made some songs and music videos with them that made it big on the Billboard charts. This really helped his popularity. He released a double CD with the songs on it and a lot of his own songs and sold millions of copies (u.a., n.t., n.p. letter code D) More people were influenced to buy his CD. People listened to the music and did what he said he did. So Tupac was influencing all of these people. Tupac was rich and famous now. He was showing off his own style now and didn't need his popular friends. This is the time that many people saw the real Tupac and loved him. He was now very influential to fans. They wanted to be just like him. He starred in more movies and could be who he really was. He did a lot of interviews that showed his beliefs. He said self esteem and self respect was very important and said "I feel as though I am a shining prince just like Malcolm and feel that all of us are shining princes, and if we live like shining princes, then whatever we want can be ours. Anything." (Patrick, Tony, n.p.) And when he says all of us, he means all men. He also said he doesn't care if someone is white or black. And no one can be judged by their skin. "So just because it's Black don't mean it's cool, and just because it's White don't mean it's evil."(Patrick, Tony n.p.) If he judged a man, he judged them by what they do ... ...nds for a new beat really separated his music from others. He didn't use traditional beats that people get tired of.
